On Saturday, August 8, 2009, officers of the Garden City Police Department were dispatched to St. Catherine Hospital to investigate the alleged sexual assault of two teenage girls, ages 13 and 15. It had been reported that the two girls were walking in the northwest part of Garden City at approximately 2:00 a.m. when they were abducted by five Hispanic males driving a dark colored sport utility vehicle. It had been reported that the girls were driven to the country where they were sexually assaulted and then returned to Garden City and dropped off in the center part of town.
Based upon evidence produced by further investigation, on August 12, 2009, the Finney County Attorney’s Office commenced a juvenile offender proceeding against Carlos Macias, Jr., age 16. Carlos Macias, Jr. was charged with three counts of Rape, two counts of Aggravated Criminal Sodomy, two counts of Aggravated Kidnapping, all severity level 1 person felonies, and two counts of Aggravated Battery, both severity level 7 person felonies. The Respondent was lodged in the Finney County Juvenile Detention center. The State then filed a Motion to Certify Mr. Macias, Jr. to have him stand trial as an adult and he was then removed from the detention center and lodged in the Finney County Jail.
Based upon further evidence developed by the Garden City Police Department the evening of August 19, 2009, and made known to the Office of the Finney County Attorney, on August 20, 2009, the County Attorney’s Office has dismissed all charges against Carlos Macias, Jr. and directed the he be forthwith released from the custody of the Finney County Sheriff. The matter remains under investigation.
